A restraining order (also called a “protective order”) is a court order that can protect someone from being physically or sexually abused, threatened, stalked, or harassed. A restraining order can include personal conduct orders, stay-away orders, and/or residence exclusion (“kick-out” or “move-out”) orders. The person getting the restraining order is called the “protected person.” The person the restraining order is against is the “restrained person.” Sometimes, restraining orders include other “protected persons” like family or household members of the protected person.

Being served with a Restraining Order is a serious matter. The consequences to you can be severe. If you do not hire a law firm to defend you, it is much more likely that the restraining order will be granted against you. It can make you subject to criminal prosecution for violating its terms, you could be ordered to pay costs and attorney’s fees for the requesting party, they could affect the custody of your children, and you could find yourself excluded from your place of residence.   These issues can sometimes affect your employment or your immigration status.
